COPYRIGHT NOTICE
All intellectual property rights in the AquaSoft software and user documentation
are owned by and are the proprietary interest of Siam Natural Resources
Co., Ltd. (hereinafter referred to as "SNR") and are protected
by copyright laws of the Kingdom of Thailand, other applicable copyright
laws and international treaty provisions. Your rights with regard to the
software and manual are subject to the restrictions and limitations imposed
by such laws. Under the copyright laws, neither the programs nor the manual
may be copied, reproduced, translated, transmitted or reduced to any printed
or electronic medium or to any machine-readable form, in whole or in part,
without the written consent of the copyright holder.
"AQUASOFT" SOFTWARE LICENSE STATEMENT
The software described in this manual is protected by copyright laws. You
must not copy the software for any purpose other than making archival copies
for the sole purpose of backing-up your software for protection against
loss. You are only licensed to use the software on one machine at a time.
You may not rent or otherwise distribute the software. You agree not to
reverse engineer, disassemble or decompile or attempt to derive the source
code from the software.
LIMITED WARRANTY
1. Siam Natural Resources warrants to you that the software will perform
substantially in accordance with the documentation for a period of sixty
(60) calendar days after delivery to you. You shall have a period not to
exceed thirty (30) calendar days from the date of the delivery of the Program
or from the completion date of any customisation of the Program by Siam
Natural Resources in which the Customer shall have the opportunity to test
the Program by means of any non-productive use which is reasonably appropriate
for determining whether the Program operates in conformity with the User
Documentation. Any deficiencies or defects in the Program from the User
Documentation discovered during such testing period shall be put in writing
to Siam Natural Resources within three (3) days of such discovery. In the
event that the Customer does not record any defect or deficiency in the
manner provided herein the Program shall be deemed to be accepted as of
the end of the thirty (30) day testing period provided herein.
2. In the event that Customer discovers a defect or deficiency in the Program
from the User Documentation, Siam Natural Resources shall exercise its best
efforts to repair such defect or deficiency and thereafter give notice to
the Customer that the repair is complete. The Customer shall have a period
of seven (7) working days in order to re-test the Program. The Customer
shall give written notice to Siam Natural Resources of its basis for continuing
rejection of the Program during such seven (7) day test period or the Program
shall be deemed to be accepted by the Customer as of the end of such testing
period.
3. The Customer shall not be licensed hereunder to make any productive use
of the Program until the Customer has accepted the Program pursuant to the
procedures in Subsections (a) and (b) of this section. Any productive use
of the Program by Customer prior to such acceptance shall be deemed to be
acceptance of the Program.
4. SNR warrants that the diskette on which the Aquasoft software titles
are recorded will be free from defects in materials and workmanship for
a period of thirty (30) calendar days from the date of purchase. If within
thirty (30) calendar days from the date of purchase the diskette(s) prove(s)
defective SNR will replace the defective diskette free of charge
5. SNR shall not be liable for errors contained herein or for incidental
consequential damages in connection with the furnishing, performance or
use of this material.
6. Except for the foregoing limited warranty, SNR makes no warranties, express
or implied, including without limitation the implied warranties of non-infringement
of third party rights, merchantability or fitness for any particular purpose.
The foregoing warranties are given in lieu of all other warranties, express
or implied, including warranties of non-infringement of third party rights,
merchantability or fitness for any particular purpose. The Customer's sole
and exclusive remedy and the Company's exclusive liability hereunder shall
be limited to the cost of replacement of the program or refund of the purchase
price.
DISCLAIMER
In no event will SNR or anyone else involved in the creation, production,
delivery or licensing of the program be liable to you for any consequential,
special, incidental, direct or indirect damages of any kind, including but
not limited to lost profits, lost savings, system crashes or lost data arising
out of the use or misuse of, operation, inability to use the program or
any defect in the program even if SNR or anyone else involved in the creation,
production, delivery or licensing of the program has been advised of the
possibility of such damages.
